Kiryas Joel Dissidents Lose Appeal


NEW YORK — A federal appeals court ruled in favor of Kiryas Joel's majority faction Monday, rejecting arguments the village should be dissolved because its leaders discriminate against dissidents and violate the constitutional separation of church and state.

The appeals panel agreed with a U.S. District Court ruling that many of the claims dissidents presented as evidence of persecution already had been tried in state court and couldn't be litigated again. The judges also agreed the plaintiffs lacked standing to bring certain other claims.

The plaintiffs, including an umbrella group known as the Kiryas Joel Alliance, filed the lawsuit in June 2011.
