Frank Carrone used City Hall connections to broker big money real estate deals, why does he care about stopping a small, independent blogger?

What Frank Carone wants, Frank Carone gets — even if he’s asking the mayor of New York City.

The politically connected lawyer, who emerged this week as a central architect behind the city’s $173 million real estate deal with the notorious Podolsky brothers, has enjoyed unfettered access to City Hall since Mayor de Blasio took office in 2014, the Daily News has learned.

De Blasio was mayor for less than two months when his top aide, Emma Wolfe, got an email from the Brooklyn attorney with the subject line “Jobs in the New Administration.”

In it, Carone, who has served as counsel to the Brooklyn Democratic Party for nearly 10 years, forwarded a list of names and a message from Brooklyn Democratic Party Leader Frank Seddio seeking to secure jobs for LGBTQ people in the new administration. The note was originally from Matthew McMorrow, the former president of Brooklyn’s Lambda Independent Democrats political club.

“If there is a need or interest please let me know,” Carone wrote Wolfe.

More names and resumes followed, emails obtained through a public records request show.

In a March 19, 2014 message, he forwarded Wolfe a resume from a Richard DiMaio, looking for a graphic designer job in the Health Department:

“Hi! Frank asked that I send you the attached along with the city job posting for his weds. meeting with the mayor," DiMaio wrote in a note that accompanied it. “Can you please ensure he gets this as well as put this on his agenda? Thank you so much!”

DiMaio shares a last name with Frank Seddio’s daughter, Grace Seddio-DiMaio. A Richard DiMaio started work as a graphic artist at the Department of Design and Construction in 2014, public records show. He did not respond to messages from The News.

Aside from sending resumes and working for landlords like Jay and Stuart Podolsky, Carone has regularly asked the mayor’s office to intervene when clients faced roadblocks at city agencies, with senior mayoral staffers responding with pledges to look into issues large and small — from zoning variances to plumbing licenses.

In one September 2014 email to mayor’s office staffer Mike DeLoach, it’s clear Carone had more than one matter before City Hall at any given time.

“Mike, thanks for your help on DOT issue. Just checking in on BBP settlement talks?” he wrote. Carone at the time represented the People For Green Space Foundation, a Brooklyn Heights group who sued to stop mixed-income housing in Brooklyn Bridge Park.

He and the law firm he works for, Abrams Fensterman, have represented many other clients mired in controversy, or with business before the city — or both.

They include the Allure Group, which was at the center of the Rivington House scandal that plagued de Blasio’s first term; the Fortis Property Group, the buyer in the controversial Long Island College Hospital deal; and Haysha Deitsch, the developer who had to pay out a $3.4 million settlement for evicting seniors from a Brooklyn nursing home.

Carone’s most well-known clients at the moment are the Podolsky brothers. They pleaded guilty to dozens of felonies in 1986 in relation to their treatment of tenants in their properties.

In 2016, Homeless Services Commissioner Steve Banks contacted Carone about the city’s intention "to take the steps necessary” to acquire 17 cluster-site buildings in Brooklyn and the Bronx through eminent domain. In 2018, the city made its intention to buy those properties public, but failed to mention who owned them — the Podolskys — and who represented the owners — Carone, who funneled $5,000 to de Blasio through his Fairness PAC.

In January, The News revealed the Podolskys were behind the deal, and in the subsequent weeks, broke the news that the city would shell out $173 million for the 17 buildings, despite two wildly divergent appraisals that listed the properties’ value alternately at $49 million and $143 million.

Despite the multi-million dollar largesse from the city, Carone and his clients haven’t always gotten what they wanted from the city — but certainly seemed entitled to it when asking.

He repeatedly emailed the mayor’s office regarding the Department of Homeless Services’ threats to stop renting apartments in a decrepit “cluster site” homeless building on Mosholu Parkway in the Bronx.

In an email to de Blasio aide Avi Fink, Carone complained about a letter from the agency to shelter operator Aguila, calling it “aggressive and unfortunate.”

Later, when another group, Acacia, took over the site, Carone emailed Fink what sounded more like a command.

“17 and 19 Mosholu Parkway. Whatever needs to be done to remove the stigma that seems to persist but is factually inaccurate. Thanks," he wrote.

Despite Carone’s efforts, DHS stopped using the building as a shelter.

A de Blasio spokesman defended the mayor’s relationship with Carone.

"It’s extremely common for residents of all sorts to reach out to City Hall and city employees seeking guidance on an issue,” spokesman Eric Phillips said. “It’s our job to help them navigate their city government, whether they’re people involved in politics or people we meet on the subway or people who ask the mayor questions on the street.”

The city struck a $173M deal with landlords who have a laundry list of housing violations

Mayor Bill de Blasio struck a $173 million deal with two landlords that have more than 400 housing code violations.

City records show that 17 of the 21 buildings the administration bought to provide affordable housing have problems that are “immediately hazardous,” the New York Post reported. That includes mice and roach infestations, peeling lead paint, water leaks and broken locks.

One four-story walk-up in Crown Heights has 56 open violations. A resident there noted that her unit doesn’t have a smoke or carbon monoxide detector and the unit has water damage.

At another building, 710 E. 243rd St. in the Bronx, Dawn Bazemore said she and her two kids live in a two-bedroom apartment that’s “falling apart.” Bazemore said water drips from the ceiling and the light fixtures, most of which don’t work — and the drain pipe in the bathroom sink is rusted.

The de Blasio administration opted to buy the buildings in Brooklyn and the Bronx two years ago from the Podolsky brothers, two landlords with a long record of violations who are currently under federal investigation for tax fraud. And the lawyer who represented them in the portfolio sale to the city is Frank Carone, is a longtime de Blasio ally and fundraiser.

Initially, the total value of the buildings was estimated at about $50 million. A private appraiser later estimated it at $143 million. City officials said the price rose during the course of negotiations with the Podolsky brothers, who run Amsterdam Hospitality Group.

Suit Over Leaning Tower Aims to Stop Curtainwall Work, Seeks Redesign

General contractor Pizzarotti has filed a suit against developers FPG Maiden Lane and Fortis Property Group in the New York Supreme Court last month, alleging that 161 Maiden Lane in downtown Manhattan is leaning 3 inches to the north due to settlement of the foundation. It claims that the settlement has caused the building’s superstructure, including the curtainwall, to lean, making any further work on the curtainwall unsafe.

“Although the superstructure has been complete since September of 2018, the curtainwall system has been stalled for months because FPG and its design professionals and consultants have refused or neglected to provide a comprehensive redesign of the curtainwall system to accommodate the leaning and curved condition of the building, and the movement of the structure because of the anticipated further settlement of the foundation,” reads the complaint.

Pizzarotti claims that FPG primarily considered cost when determining to proceed with a soil improvement foundation method rather than deep foundation piles driven into bedrock, despite a consultant warning that the soil improvement method would result in additional settlement of the foundation.

In April 2018, the concrete superstructure subcontractor advised that there were structural issues and unusual settlement up to 3 inches. The subcontractor then requested direction from FPG’s engineer or record, according to the suit. In June 2018, Pizzarotti’s curtainwall subcontractor, AGM Deco, advised that the curtainwall frame, already installed, showed approximately 2 inches difference to the north from floor 11 to 21.

“After investigation and testing, it was confirmed by FPG and its consultants, that the building was in fact leaning, as a rigid body, outside of its vertical control,” reads the suit.

Pizzarotti claims in the suit that, based on expert engineering information and analysis, the increased load from heavy construction elements, such as the curtainwall, yet to be added to the structure will cause additional settlement and movement.

The complaint lists several of Pizzarotti’s service and safety concerns, including the “strength of the cladding attachments not only in the static lean condition but also in a design wind storm condition. As the change in lean has not been predicted it cannot be incorporated in the facade panel engineering. The impacts of this can range from inoperable windows to breaking windows and components falling to the street.”

According to the suit, Pizzarotti claims that work on the project should not proceed any further until the expected future movement of the building is appropriately assessed. The general contractor also says in the suit that FPG has “failed to provide Pizzarotti with sufficient design information, as required by the construction management agreement (CMA), for Pizzarotti to proceed with the work in a safe and proper manner.”

The suit seeks:

A declaration that Pizzarotti’s CMA has been properly terminated due in part to more than 120 consecutive days of stopped work;

A permanent injunction prohibiting defendants and their agents from proceeding with work on the project, or requiring the general contractor or its subcontractors from proceeding with work on the project, until an adequate, safe and proper redesign is provided; and
Costs awarded.

A spokesperson for Fortis refuted the claims in a statement provided to Commercial Observer, which originally reported on the suit.

“As two of the top engineering firms in the world—Arup and WSP—have certified, there are no safety issues at the building and construction can continue immediately,” said the statement. “The fact that Pizzarotti has had more than 70 of its own employees and subcontractors working throughout the building over the past several months (including as recently as last week) substantiates Pizzarotti’s duplicity and underlying intent to defame the project. This is simply a matter of a slight redesign of the building’s curtainwall, which is already being worked on by our new general contractor, Ray Builders.”

Brooklyn Heights neighbors furious over unpermitted work at former LICH property

Fortis sold Willowtown building, but current ownership murky

Neighbors are fuming that the owner of a multifamily building in the Willowtown section of Brooklyn Heights has continued demolition work despite numerous violations reported to the Department of Buildings over more than a month.

Real estate websites have already listed apartments at 43 Columbia Pl., one of the 20 former Long Island College Hospital (LICH) properties bought by developer Fortis Property Group.

Members of the community as well as the Willowtown Association, however, say they have called in numerous complaints about unpermitted work there, and are pushing to have the work halted.

Despite the violations and a Partial Stop Work order, the work has continued unabated, says Linda DeRosa, president of the Willowtown Association.

“At this point they have completely destroyed the rear façade of the building and are doing roof work including installing AC units without approvals,” she said in a letter of complaint to local officials last week.

Neighbors said that the new owner appeared to be adding an illegal penthouse or other roof structure.

Last week, the Landmarks Preservation Commission (LPC) issued a violation for unpermitted work on the front façade and roof, and another for the ongoing alterations to the rear façade, including enlarging openings, installing doors and constructing terraces. A third violation was issued for the removal of windows.

Representatives of Councilmember Stephen Levin’s office told the Brooklyn Eagle that they have reached out to the Department of Buildings (DOB) and the LPC.

“DOB and LPC were on-site yesterday with our staff and DOB is planning to do a full audit of the building plans to assess the work being done,” Casey Adams, Levin’s deputy chief of staff, said on Tuesday. “We will continue to monitor the situation and facilitate communication between concerned constituents and agencies as the issue is being reviewed.”

Peter Bray, executive director for the Brooklyn Heights Association, told the Eagle that the building’s owner has retained Brooklyn Heights architect Tom van den Bout, “which seems to indicate that they are no longer ignoring the warnings they have received and are prepared to remedy the illegal work.”

Whether the unpermitted work would be able to stand is unclear, but would be subject to LPC review and approval.

Ownership of building is unclear

The ownership of 43 Columbia Pl. is murky. Numerous city records indicate that the new owner shares an address with a former owner.

According to documents filed with the City Register, Fortis Property Group, under the name of FPG Ch 43 Columbia, LLC, bought the property from SUNY via the Downstate at LICH Holding Company on Sept. 1, 2015 for just over $5 million.

FPG Ch 43 Columbia, LLC sold the property nine days later, on Sept. 10, 2015, for roughly $2.6 million to a company with a similar name: FPG Ch 43 Columbia Holdings LLC. This company’s address is listed as 5308 13th Ave. #165 in Brooklyn.

Applications to the LPC to do work in a historic district must be signed by the owner of the property, according to LPC rules. For interior renovations at 43 Columbia Pl., the LPC in August issued a permit to a Charles Wurzburger of Marion Holdings 201 LLC, also listed at 5308 13th Ave. #165 in Brooklyn.

In a superseding letter regarding a contractor, filed with DOB on Oct. 30, 2015, the owner/manager was listed as a David Sinai (also spelled Sinay). City documents list his address as 5308 13th Ave. #165 as well.

A search on Google found that 5308 13th Ave. is a cell phone store that rents mailboxes in Borough Park.
