The company OU Kosher has filed a lawsuit against food
manufacturer Better & Different Ltd. for trademark infringement, according
to a report by Jewish Business News.
In the suit, the Union of Orthodox Jewish Congregations in
America's representative in Israel claims Better & Different used its
trademark labeling of kosher food without paying licensing fees in 2012, the
report said.
Better & Different claimed in March that it has not used
the union's trademark – the letter O encircling the letter U – for two years,
but recent examinations countrywide have shown products made in 2012 and 2013
still bore the symbol, according to Jewish Business News.
The union has asked the court to prohibit Better & Different
from continuing to present or market its products with the OU Kosher trademark,
to destroy packaging that bears the trademark and to recall products with the
trademark from stores to which they were distributed, Jewish Business News
reported.
Furthermore, the union is reportedly seeking monetary damages
amounting to NIS 200,000 ($56,000).
