NY - Manhattan DA Investigating Shelly Silver’s Kids to Determine Possible Voter Fraud

ALBANY — The Manhattan District Attorney’s office is reviewing the actions of three of Assembly Speaker Sheldon Silver’s children who voted for their father even though they no longer live in the district.

A source familiar with the situation told the Daily News the review is preliminary and being undertaken to determine if a bona fide investigation is warranted.

A spokeswoman for District Attorney Cy Vance Jr. declined comment.

It is extremely rare for an individual in New York to be prosecuted for voter-registration discrepancies.

State Board of Elections rep John Conklin said courts have given wide latitude, ruling in one case that one can register to vote “as long as there is legitimate, significant and continuing attachments” to a residence.

Those close to Silver claim the speaker’s lower East Side apartment remains a family residence.

A Silver rep said the lawmaker’s children “all vote from only one place, and under New York law that is clearly legal.”

Brooklyn lawyer John O’Hara in 1999 was the first person since Susan B. Anthony in 1873 to be convicted of voter fraud.

He registered at his girlfriend’s address, not his own.
