Criminal investigation against Rabbi Eliyahu for ’Racism’

The government is opening a criminal investigation against Tzfat Chief Rabbi Shmuel Eliyahu on suspicion of racism against Arabs.

The government is opening a criminal investigation against Tzfat Chief Rabbi Shmuel Eliyahu on suspicion of racism against Arabs.

Attorney General Yehuda Weinstein said that the investigation will not involve statements that the rabbi made as part of decisions based on Jewish law, such as the ruling by Rabbi Eliyahu and 50 other rabbis that a Jew should not sell or rent homes to non-Jews.

Weinstein adopted the recommendations of government prosecutor Moshe Lador, who said racism is suspected in statements to the media by Rabbi Eliyahu, whose father was the late Chief Rabbi of Israel, Rabbi Mordechai Eliyahu.

Among other statements that are being probed are, “The Arab culture is very cruel,” and “When talking about Arabs, people speak in codes that normalize violence and turn into ideology.”

He stated that examples of the “ideology” are stealing farm equipment from Jews and blackmailing farmers for protection against thefts.

The minute you make room for Arabs among Jews, it takes five minutes before they start to do whatever they want,” he also has been quoted as saying.

Rabbi Eliyahu’s statements were made following complaints that Arabs were moving into Jewish neighborhoods and disturbing Jews in Tzfat, one of the four traditional holy cities. The others are Jerusalem, Hevron and Tiberias.

Rabbi Eliyahu also has said, “Jews do not have to flee from Arabs. They need to make them flee,” and “Moving Arabs out of Jewish neighborhoods is a strategic act.”

The government charged Rabbi Eliyahu in 2006 with racist remarks against Arabs, and he agreed to state that he does not associate himself with the remarks cited in the indictment.

Among other things, Rabbi Eliyahu said:

* "Arab culture is very cruel."

* "Arabs have a different codes and norms that have become ideology. Such as the agricultural thefts, which have become part of Arab ideology."

* "Their behavior is unpleasant. An elderly Arab lady who recently moved into our Amidar neighborhood has already become a nuisance. Every Shabbat 10 cars filled with Arabs visit her. They play music, make noise."

* "Arabs treat their women according to social norms that are supported by the Quran which allow them to hit women – and with them these are not mild blows. These are blows with chairs –abuse that ends with the woman being admitted to the hospital."

* "A Jew should not run away from an Arab. A Jew should chase away Arabs."

* "Expelling Arabs from Jewish neighborhood is part of the strategy."

היועץ המשפטי לממשלה, יהודה וינשטיין, החליט על פתיחה בחקירה פלילית כנגד הרב שמואל אליהו, רב העיר צפת, בחשד לפרסום הסתה לגזענות. הסיבה להחלטה היא התבטאויות שונות של הרב על הערבים בישראל בראיונות לתקשורת. עם זאת, החליט וינשטיין כי אין מקום לפתוח בחקירה פלילית בשל "מכתב הרבנים", פסק ההלכה שפרסם הרב בשיתוף עם רבנים נוספים.

ההחלטה התקבלה בעקבות תלונות שהגיעו למשרד היועמ"ש על התבטאויות הרב סביב המאבק נגד כניסת ערבים לצפת. וינשטיין הנחה גורמים במשרדו לבדוק אם יש היבטים פליליים בהתבטאויות של אליהו ובחתימה על פסק ההלכה, ביחד עם עוד כחמישים רבנים אחרים, לפיו אין למכור או להשכיר דירות למי שאיננו יהודי.

הפרשה החלה סביב מסע שהחל אליהו ב-2010 ואיתו רבנים וגורמים נוספים, נגד השכרת דירות, מכירתן או השכרת חלקת אדמה בארץ ישראל לגוי. במהלך הפעילות שהתמקדה בצפת, הוצתו גם מכוניות של ערבים. שניים בני אדם נעצרו בחשד למעורבות בכך.

החקירה הפלילית תתמקד בחשד לפרסום הסתה לגזענות בשל התבטאויות כוללניות נגד ערבים, שנאמרו במסגרת ראיונות שהעניק לכלי התקשורת. לדברי היועץ אמירות אלה מעלות חשד לפרסומים גזעניים.
