NY - Jewish Doctor Who Hired Hitman to Kill Husband Loses Appeal


A Queens woman serving a life sentence for having her estranged dentist husband gunned down in front of their young daughter has lost her appeal to overturn the conviction despite errors made by prosecutors.

Dr. Mazoltuv Borukhova was found guilty of first-degree murder and conspiracy after she hired cousin Mikhail Mallayev to kill hubby Daniel Malakov on the morning of Oct. 28, 2007.

Borukhova’s appeals lawyer, Alan Dershowitz, charged that several statements introduced into evidence by prosecutors should not have been allowed because his client had not been given her Miranda warnings.

The Appellate Division agreed that was a mistake but found that the evidence against Borukhova was so “overwhelming” that it didn’t affect the verdict.

Queens District Attorney Richard Brown said he was hopeful the ruling “would bring a measure of closure to Dr. Malakov’s family.”

Malakov was shot in the back in front of the couple’s 4-year-old daughter, Michelle, at a Queens park. The couple had been in the middle of a bitter custody battle.
